By registering for and participating in any PES Learning Course (“Course”), you (“Participant”) agree to be legally bound by the following Terms and Conditions. Please read them carefully.


1. Eligibility and Compliance

Participants must be at least 18 years old. It is the sole responsibility of the participant to ensure they meet all prerequisites, licensing, or certification requirements as set by their jurisdiction.


2. Course Content and Educational Purpose

The Course is intended for general educational purposes only. While the Course content is designed to reflect best practices and applicable legal standards, it does not constitute legal advice or guarantee qualification, certification, or employment as a public guardian.

Participants are encouraged to consult with appropriate licensing boards, courts, or legal professionals regarding certification or professional responsibilities.


3. Payment and Refunds

All payments must be made in full prior to receiving access to course materials. No refunds will be issued to any student for any reason once the course has been accessed. Fraudulent disputes will be handled in small claims court where attorney fees, judgments, etc. will be paid for by the student. We will aggressively pursue legal action against fraudulent disputes.

No refunds will be issued for incomplete courses, failure to pass assessments, or lack of qualification by a certifying body.


4. Intellectual Property

All course materials, including but not limited to videos, presentations, PDFs, and written content, are the intellectual property of PES Learning and are provided solely for personal, non-commercial educational use.

Participants may not reproduce, distribute, or share course materials without express written consent.


5. Certification

Completion of the Course may include a certificate of completion; however, such certification does not imply or guarantee approval by any state, court, or licensing authority.

It is the responsibility of the participant to verify whether this training meets the specific requirements of any agency or jurisdiction.


6. Code of Conduct

Participants agree to engage in the Course in a professional, respectful manner. Any form of abuse, harassment, or cheating may result in termination of course access without refund.


7. Limitation of Liability

PES Learning shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the course materials, platform, or any associated content.


8. Indemnity

The Participant agrees to indemnify, defend, and hold harmless PES Learning, its instructors, directors, employees, and affiliates from and against any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from:

This indemnity obligation shall survive the completion of the Course and termination of the Participant’s access.


9. Modifications

PES Learning reserves the right to update or modify these Terms and Conditions at any time. Continued use of the Course platform after such changes constitutes acceptance of the updated Terms.


10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles.
